Graham had pointed that out in his challenge to the Fulton County subpoena asking him to testify Tuesday. The appeals panel — made up of Judges Charles Wilson, Kevin Newsom and Britt Grant — said in its order that the district court could expedite notification of the subpoena amendment in any manner the judge “deems appropriate.” The appeals court said that after this issue is resolved, the matter will return to the appeals court for further consideration.
